Don’t Get Burnt!
Penalties for infringement of copyright are getting tougher, and every venue or DJ with a hard drive system that is playing copied music should be very, very nervous. It seems people still don’t understand that, unless you hold an AMCOS licence and have written permission from the record company or ARIA for each individual recording, it is against the law to copy music onto a hard drive!

The Australian Record Industry Association (ARIA) has set up Music Industry Piracy Investigations (MIPI) as a policing body to target music copyright infringements.

Michael Speck, General Manager of MIPI says, “Our surveillance programs run 7 days a week and investigators work a 24 hour roster. This means we get to cover a lot of ground. We average an arrest every two weeks. By way of example, we currently have 34 DJs, Jukebox operators and venues (and their operators) in the process of being prosecuted civilly. A further 5 DJs are awaiting criminal prosecution. Over 120 notices have been served in the past year for MP3 piracy alone.

“Apart from issuing fines, prosecutors confiscate the equipment involved for destruction. Even if you are lucky enough to convince a court that you should get some equipment back, you can be sure that it will have been seized for so long that it is out of fashion or superseded!

“At any given time, MIPI is able to identify current or emerging trends in infringing behaviour. This is one of the things that make us so successful. At present there is a real problem with operators and venues using hard drives to play illegally copied music and, no matter which way you view it, this is illegal. Over the years, our investigators have heard every conceivable excuse for this form of piracy.

“Yes, using hard drives to play copied music without the authorisation of the copyright owner is piracy, no matter what your explanation. The sheer size of the problem here has resulted in MIPI adopting newer approaches to piracy.

“We recently undertook an undercover sting operation targeting jukebox operators in Melbourne and will be taking the operation on the road soon. Put simply, you will never know if your customer is just that, or an anti-piracy investigation.”

In closing Michael Speck says, “Copyright is what gives us all our business or work. Without it you don’t have the ‘music business’. So if you know of someone ripping off music let us know! Our email address is mspeck@mipi.com.au. We hope to hear from you!”

So there you have it, if you have copied music onto hard drive without permission, sooner or later you will be caught and fined. It would seem that there might just be a few folk out there in for the odd sleepless night!

October New Releases

Deck the halls... Holly Valance returns this month with a new single called State Of Mind. It’s from her upcoming, yet to be titled, 2nd album. The track is an addictive, trance influenced affair, reminiscent of the likes of Felix Da Housecat and is already gaining UK radio airplay. Hear it now on CR91.

Electronic dance kings Chemical Brothers have teamed up with wacky Flaming Lips frontman Wayne Coyne to record a psychedelic, up-tempo new track. The Golden Path is one of two brand new tracks featured on the duo’s best of collection Singles ‘93 - ‘03 and marks quite a significant change in direction for Tom and Ed. Check it out from CR91.

California native, newcomer Nodesha found her calling early in life inspired by the likes of Janet Jackson. Now signed to Flyte Tyme Records run by the legendary Jimmy Jam and Terry Lewis - the same team that produced most of Janet’s biggest hits - Nodesha unleases her steamy dance debut single called Get It While It’s Hot. Play it from CR91.

Travis are back with a new single called Re-Offender. Fran (with obligatory new haircut), Dougie, Andy and Neil have a lot to live up to, but with this they prove that they can still pen a cracking tune. It’s the first single to be taken from the band's 4th album 12 Memories, their first since 2001's massive-selling The Invisible Band. Re-Offender sounds like the Travis we know and love and gets better with each listen. Play it from ED91.

New 4-piece rock outfit from Melbourne, Jet wear their influences on their sleeve yet spit out a sound that is uniquely their own. Their debut album, Get Born, was recorded in LA’s Sunset Sound with reknown producer Dave Sardy. The first offering from this, Are You Gonna Be My Girl, is proof enough that Jet are at the top of their game and are on their way to the top of the 21st century garage rock pile. From CRX91 and RD91... PLAY IT LOUD!!!

After the massive success of Crazy In Love, Beyonce follows up with Baby Boy, another steamy smash from her debut solo album Dangerously In Love. Dancehall saviour Sean Paul jumps aboard and does his ting ting over the Middle Eastern influenced club banger. Beyonce’s vocal is, as always, thick and flawless. The girl’s got it goin’ on and the track hit the clubs two weeks ago on CRX91.

Produced by Israeli-born Matti Schwartz, with vocals from talented singer/songwriter Joel Edwards, Deepest Blue release a superb houser also called Deepest Blue. It’s a sublime slice of groovy house that's perfect for those long summer days and sweaty nights that will soon be upon us. Check it out from CR91.

Also this month we are featuring selections from Brisbane’s best kept secret, PTY LTD. The tracks are from their smooth and extremely funky album You Should Be Like This More Often. The secret’s out... get behind these guys, they’re on our audio only Café update CF13

DJ DTM - The Deck. Hamilton, NZ.
Working in a party bar 5 years ago in Taupo, Damien Mitchell was ‘thrown in at the deep end’ one night when his manager asked him to fill in as DJ. It was a roaring success and he ended up with the job! These days 23 year old Damien mixes tunes at the state-of-the-art Riverside Entertainment Centre in Hamilton, ‘The Deck Bar and Nightclub’.

It’s a complex gig attracting many different types of people during the night from the casino below and adjacent bowling facility. Not having the luxury of a regular crowd to feed his dancefloor means Damien has to choose his music carefully to keep things pumping.

He enjoys tennis, computing and music and would love to meet Christina Aguilera. His fave artist of all time is Soane, a funky NZ house DJ who produces some very cool beats. Would love to own a McLaren F1 and currently drives a Toyota Supra.

Technically Speaking - [F5] MAKES UPDATING YOUR LISTS EASY
The [F5] key essentially has two functions – it allows you to see which Lists a song is in, and it lets you update your User Lists quickly and easily.

A practical and easy way to see which List a song appears in, press [F5] and a pink pop-up box will show every List containing the selected song.

The HDMS™ allows two types of music lists – pre-selected Nightlife Lists that you cannot edit and User Lists that you can create and edit yourself. When you install your new music, the Nightlife Lists are automatically updated. However, you will need to update your User Lists and can do this by using [F5].

In any Search screen, highlight your chosen song, eg “Never Gonna Leave”. Hit [F5]. The pop-up box will show you the Lists the song is in.

To edit your User Lists, hold down the [Ctrl] key and hit [L]. This will open a screen that shows you all the Lists on your system. A small + on the left of the song title indicates that the song you selected is in that particular List. You can add or remove your song from your List. Begin by using the arrow down/up key to highlight the List you want to edit, then hit [Enter]. You have now added “Never Gonna Leave” to this User List. The prompts will appear at the bottom of your screen in the grey dialogue box. The + will appear next to the selected List to show “Never Gonna Leave” is now in that List. To remove the song, highlight the relevant List and follow the prompt by hitting [Enter]. You can exit this screen by hitting [Esc].

The [F5] box will update itself. If you hit [F5] again, you will close the pop-up box.

For help with using new features on your HDMS™, or for any technical assistance, call Tech Support on 1800 773 468.

News From NZ

News Flash! Kiwi Disc Is Coming!

We are working towards creating a New Zealand only music update that will be called NZX.

This new library will be offered to all our customers and will include a combination of new music and classics from New Zealand artists. We will also be including some audio only releases for those songs where no video footage is available.

Compiling this library involves quite a bit of work and requires a combination of obtaining licence clearance, the archival video footage with quality audio, and co-ordinating production.

Our steadfast production team hope to have NZX released to you in the near future and it will become an ongoing monthly update.

Stay tuned!
